These terms of use (hereinafter referred to as: Conditions) apply to the use of the apps, games and websites from The App Capital (hereinafter referred to as: Services). You can download, save or print these Terms.

By accessing or using the Services, you agree to these terms.

1. General

1.1 The Services are offered by The App Capital, Chamber of Commerce number 60859822 (hereinafter referred to as: The App Capital).

1.2 The App Capital can adjust these Terms and Conditions in view of new developments. The most recent version can be found on the website: https://bibblebabble.app/terms-of-use/.

1.3 The Services and their content are for general information and/or entertainment purposes only and are not intended as advice.

2. Definitions

Services: apps, games, websites and content developed by The App Capital and made available to users for use on a mobile phone or other device and any updates made from time to time and any other software or documentation that facilitates the use of enable these Services.

Content: All data (including images and sounds), software, files, ideas or other information accessible through the Services.

Equipment: The (peripheral) Equipment, including a smartphone, tablet or PC with which you use the Services, including the associated operating system.

3. Using the Services

3.1 You can use the Services without an account or login details.

3.2 It is important to use the latest version of the Services. If you are not using the latest version of the Services they may not function properly or not at all.

4. Handling the Services with care

4.1 In order to use the Services properly and safely, you must use the most current operating system and software that your device supports. Otherwise, the Services may not work or not work properly.

4.2 To prevent misuse and/or malfunctions and/or other problems, you must ensure that your equipment and connections are sufficiently secure.

5. Purchase

5.1 For paid Services, you pay the price displayed at the time of purchase.

5.2 The price of all Services, including free Services, may be adjusted by The App Capital at any time.

5.3 You bear the costs of the purchase and use of the Equipment and connections (mobile and/or wireless internet) that are necessary for the use of the Services.

5.4 An account (Apple ID) from Apple is required when purchasing apps or making In-App Purchases. The General Terms and Conditions of Apple Media Services apply to this.

6. Security Precautions

6.1 You are responsible for the use of the Services. You must follow all directions and regulations of The App Capital provided in connection with the use of the Services.

6.2 You may not use the Services in an unauthorized or careless manner. The App Capital is entitled to block access to the Services in the event of abuse or unauthorized use of the Services, among other things.

6.3 If you think that you can no longer safely use the Services, do not use them. For apps, remove them from the Equipment.

7. Liability

7.1 The App Capital makes every effort to make the Services available to you. Despite constant attention, care and warranties, The App Capital cannot guarantee that the Services will function without errors and without interruption. The App Capital does not accept any liability for the consequences of any inaccuracies in the data that is accessed via the Services.

7.2 The App Capital can stop offering the Services or change the Content at any time.

7.3 The App Capital is not liable for any damage or costs incurred by you or third parties, for whatever reason, as a result of the use or inability to use the Services, unless the damage in question is caused by intent or deliberate recklessness from The App Capital.

7.4 The Services may contain advertisements or links to external sources. The App Capital is not liable for the use, content or functioning of these external sources and does not accept any liability for this. The App Capital is not responsible for the processing of your personal or other data on these external sources.

8. License and Intellectual Property

8.1 The Content of the Services, the data, images, sounds, texts and combinations thereof and other software contained therein are protected by copyright and trademark rights. These rights belong to The App Capital. You are not allowed to copy or publish, exploit or otherwise use any part of the Services without prior permission from The App Capital.

8.2 The App Capital hereby grants you a non-exclusive, royalty-free and revocable license to use the Services in accordance with these Terms.

9.Privacy

9.1 The use of the Services is subject to the privacy policy, in which you can read how The App Capital handles the processing of your personal and other data. You can find this policy at: https://bibblebabble.app/privacy-policy/.

10. Terminate and Deactivate Services

10.1 The App Capital may terminate the use of the Services at any time. Upon termination, the rights and licenses granted to you in these Terms will terminate.

10.2 For apps, you can terminate the use of the Services yourself by removing the app from your mobile device.

10.3 For Apple Subscriptions, you must terminate current subscriptions yourself via your Apple Account. The App Capital cannot cancel Apple subscriptions for you.

11. Applicable Law

11.1 These Conditions are exclusively subject to Dutch law. All disputes arising in connection with the Services and/or these Terms, including disputes about the existence and validity thereof, will be settled by the Rechtbank Midden-Nederland.

12. Other Provisions

12.1 If these Terms and Conditions are or become partially invalid, the parties will remain bound by the remaining part. The parties will replace the invalid part with stipulations that are valid and the legal consequences of which, in view of the content and purport of these Conditions, correspond as much as possible to those of the invalid part.

12.2 For any questions, comments or complaints regarding Services, please contact The App Capital via the contact form.

12.3 For apps, you agree that Apple may be a third party beneficiary to the Terms and that Apple has the right to enforce the provisions of the Terms on its own behalf.
